Terms of Service

This Terms and Conditions ('Agreement') is for clients, Companies and Partners and governs the use of Funel's 'Platform' which connects Marketing Companies to their clients who may be individuals or companies.

To access and use Funel's 'Platform' as a User, you must review and accept the terms of this agreement by clicking on the 'I accept' button at the end of this text. Once accepted, this agreement becomes a binding legal commitment between you and Funel. If you do not agree to be bound by these terms, you should not click the 'I accept' button. Funel Platform

Funel Platform is a software that connects marketing companies to their clients. It acts as a bride between clients and employees of these companies. We will only be responsible for providing the platform to our clients to manage their business operations.

Registration Process

Users interested in accessing Funel's services must first complete a registration process. This involves providing accurate and complete personal and business information ("Registration Data"), including but not limited to name, contact details, and business specifics. The act of registering signifies the user's agreement to these Terms of Service and any related policies.

Account Security

Upon successful registration, users will create a unique username and password. Users are solely responsible for maintaining the confidentiality of their account credentials and for all activities under their account. It is imperative that users notify Funel immediately of any unauthorized use of their account or any other breach of security.

Registration Information

Users commit to providing true, current, and complete information during registration and to update this information as necessary to maintain its accuracy. Funel reserves the right to suspend or terminate accounts with information that is suspected to be inaccurate, misleading, or false.

Banned Accounts

Users are prohibited from creating an account if they have been previously removed by Funel or banned from the Platform. Accounts must not be used for any illegal or unauthorized purposes. Any violation may result in immediate termination of the account and legal action where necessary.

Information Update

Users can update or change their registration information at any time through their account settings. It is crucial for the effectiveness of the service and compliance with legal obligations that account information remains current and accurate.

Account Suspension

Funel retains the right to suspend or terminate an account if any terms or conditions are violated, or for any other reason at the discretion of Funel, subject to applicable laws.

Scope of Use

Funel provides a platform designed to bridge marketing companies with their clients. Users are expected to use the platform in a manner consistent with its intended purpose, which includes managing business operations and client relationships.

Prohibited Activities

Users are strictly prohibited from engaging in activities that are illegal, fraudulent, or harmful to the integrity of the platform. This includes, but is not limited to, unauthorized access to other user accounts, dissemination of malicious software, and any form of harassment or abuse towards other users.

Content Responsibility

Clients and Employees are responsible for the data they upload or share on the platform. It is imperative that all data sharing complies with applicable laws and does not infringe on the rights of others.

Compliance with Laws

Users must ensure their use of the platform complies with all applicable local, national, and international laws. This includes regulations related to data privacy, intellectual property, and online conduct.

Modification and Availability

Funel strives to continuously improve the platform and may update or modify its features without prior notice. While Funel aims for maximum availability, there may be instances of downtime for maintenance or due to unforeseen circumstances.

Feedbacks

Funel values user feedback and encourages suggestions for platform improvements. However, any feedback provided is considered non-confidential and non-proprietary, allowing Funel to use it without restriction.

Subscription Fees

Users subscribing to Funel after the trial period are required to pay subscription fees according to the chosen package. Details of the fee structure for various subscription levels will be clearly outlined through email.

Payment Terms

Fees are due as per the terms of the selected subscription package. Users are responsible for providing accurate and current payment information. Payments are typically made through secure online payment methods. It is the user's responsibility to ensure timely payments to avoid service disruption.

Billing Cycle

The subscription fee is billed on a recurring basis, as per the terms of the chosen package. The billing cycle commences from the date of subscription and recurs according to the package's schedule (e.g., monthly, annually).

Late Payments and Non-Payment

Late payments may result in temporary suspension of services. Continuous non-payment might lead to termination of the subscription. Users are advised to contact Funel's customer service in cases of anticipated payment issues.

Subscription Price Changes

Funel reserves the right to modify subscription prices. Any price changes will be communicated to users in advance, and users will have the option to accept the new prices or terminate their subscription.

User Agreement

The agreement between the user and Funel commences on the date of account registration (Effective Date) and remains in effect until terminated by either party. Users may terminate their agreement with Funel at any time. This may be done through account settings or by contacting Funel directly. Upon termination, the user's access to the platform and services will cease.

Right to Terminate

Funel reserves the right to terminate the agreement at its discretion. This may occur for reasons including, but not limited to, non-compliance with the Terms of Service, non-payment of fees, or other breaches of the agreement. Funel will provide at least thirty (30) days' notice prior to termination for convenience. Upon termination, the user will lose access to the platform and all associated services. Users are advised to ensure that all necessary data is backed up or transferred prior to termination.

Dispute Resolution

In the event of a dispute arising from or related to these Terms of Service, the parties will first attempt to resolve the issue amicably. If such resolution is not achieved within a reasonable timeframe, the dispute will be escalated for formal resolution. Funel may offer alternative dispute resolution options, such as mediation or arbitration, at its discretion.

Governing Law

The Terms of Service and any separate agreements whereby Funel provides services shall be governed by and construed in accordance with the laws of the United Kingdom. All disputes or claims arising out of or in connection with the services provided by Funel shall be subject to the exclusive jurisdiction of the courts located in the United Kingdom. Users agree to submit to the jurisdiction of these courts.

Collection and Use of Information

Funel is dedicated to protecting the privacy and security of our users' data. We adhere to best practices in data security and comply with applicable data protection laws. We collect information necessary for providing our services, including registration and payment details. This information is used exclusively for the purposes of providing, improving, and personalizing our services.

Funel does not share user data with third parties except as required for providing the services, complying with legal obligations, or as outlined in our Privacy Policy.

Users have rights regarding their data, including access, correction, and deletion. Requests regarding user data can be made through the user's account settings or by contacting Funel.

Limitation of Liability

Funel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the platform; (ii) any conduct or content of any third party on the platform; (iii) any content obtained from the platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
